USER TERMS AND CONDITIONS – PART A
1. Definitions
"Company" refers to THE FORTTUNA EVENTS ORGANIZING & MANAGING CO. L.L.C., the entity curating the Forttuna Council, registered in Dubai, UAE.
"Council" refers to the Forttuna Council.
"Member" refers to any individual or entity participating in the Council.
2. Membership Registration
Members must complete the official registration or application process provided by the Company to join the Council. The Company reserves the right to accept or decline memberships at its sole discretion. Members agree to provide accurate and up-to-date information during the registration process.
3. Participation
Members shall conduct themselves in a respectful and professional manner throughout their association with the Council. The Company reserves the right to revoke membership or restrict access if a member engages in misconduct or disruptive behavior.
4. Intellectual Property
All materials shared by the Council, including research, content, branding, digital assets, and resources, are protected by intellectual property laws. Unauthorized use, reproduction, or distribution of these materials is strictly prohibited.
5. Media Consent
Members acknowledge that the Company may capture photographs, videos, or recordings during Council events and activities. Members grant the Company the right to use such media for promotional and educational purposes.
6. Liability
The Company shall not be liable for any loss, injury, or damage sustained by members during participation in Council events or activities. Members are responsible for their own safety, decisions, and professional conduct.
7. Cancellation, Rescheduling, Postponement, and Prepone by Forttuna Council
Cancellation:
Forttuna Council reserves the right to cancel an event, activity, or program at its discretion. This may occur due to insufficient registrations, logistical challenges, force majeure, or unforeseen circumstances. Registered members will be informed promptly via email or official communication channels.
Rescheduling:
Events or programs may be rescheduled due to conflicts, availability, or other concerns. Registered members will be notified, and their registrations will be automatically transferred to the new schedule.
Postponement:
If an event is postponed, members will be informed of the revised date. They may choose to attend on the new date or request alternative options, subject to Council policies.
Prepone:
In exceptional circumstances, an event may be preponed. Members unable to attend the new date will be provided with alternative options as determined by the Company.
Refund Policy:
Forttuna Council membership is value-driven and primarily focused on networking and collaboration. Membership fees, once paid, are non-refundable. For events or services with specific fees, refund eligibility will be determined by the Company on a case-by-case basis.
Limitation of Liability:
Forttuna Council will not be responsible for any losses incurred due to cancellation, rescheduling, postponement, or prepone of events or programs, including travel, accommodation, or related expenses. Members are encouraged to make necessary arrangements to minimize risks.
8. Modifications
The Company reserves the right to modify Council programs, activities, content, and Terms & Conditions without prior notice. Members are advised to review the official website for updates.
NON-DISCLOSURE AGREEMENT (NDA)
1. Parties
This Agreement is entered into by and between THE FORTTUNA EVENTS ORGANIZING & MANAGING CO. L.L.C (“Company”) and the registered member of the Forttuna Council (“Member”).
2. Confidential Information
Confidential Information includes but is not limited to business strategies, financial data, proprietary resources, trade secrets, or sensitive materials disclosed within the Council community or during Council events.
3. Obligations
Members agree to maintain the confidentiality of all information obtained through the Council. Such information may not be disclosed, reproduced, or distributed without prior written consent from the Company. Confidential Information shall only be used for professional networking and Council-related purposes.
4. Duration
The obligations of confidentiality shall remain in effect indefinitely from the date of membership acceptance.
5. Exceptions
The obligations shall not apply to information that:
* Was already known to the Member prior to disclosure,
* Becomes public without breach of confidentiality, or
* Is lawfully obtained from a third party.
6. Remedies
Unauthorized disclosure of Confidential Information may cause irreparable harm. The Company reserves the right to seek legal remedies, including injunctive relief, for breaches of confidentiality.
7. Agreement
By registering for and participating in the Forttuna Council, the Member acknowledges, understands, and agrees to the Terms & Conditions of this Non-Disclosure Agreement.
USER TERMS AND CONDITIONS – PART B
Forttuna Council provides a platform for global leaders, innovators, and professionals to connect, collaborate, and share expertise. By submitting an application for Forttuna Council membership, the applicant acknowledges and agrees to the following:
* Information provided in the application, including achievements and documentation, may or may not be independently verified by the Council.
* Applicants agree to indemnify and hold harmless the Company, its affiliates, and representatives from any claims, costs, or liabilities arising from false or misleading information provided.
* The Company relies on the information submitted by applicants for membership consideration and does not warrant its accuracy, completeness, or authenticity.
* Applicants assume all risks associated with their submissions and the inclusion of such information in Council-related communications.
* The Company reserves the right to reject or disqualify applications at its sole discretion, without obligation to provide justification.
* Membership in the Forttuna Council does not guarantee speaking opportunities, media features, or additional benefits unless explicitly stated by the Company.
* Membership fees (where applicable) are non-refundable, except under conditions determined by the Company.
* Members are required to uphold the values of professionalism, collaboration, and integrity within the Council.
* The Company reserves the right to modify Council activities, events, and offerings as deemed necessary.
* Any decisions taken by the Company in relation to membership approvals, benefits, or activities shall be final and binding.
